List of Offenses

The following offenses require DNA testing under the laws of the Commonwealth of Pennsylvania.  This list is current as of January 3, 2003.  The requirements are presumed to apply to all subsections under these ofeenses, unless a specific subsection is noted in the statutory listing.

  • Murder, Regardless of Degree, (18 Pa.C.S.A. §2502)
  • Voluntary Manslaughter, (18 Pa.C.S.A  §2503)
  • Aggravated Assault, (18 Pa.C.S.A  §2702)
  • Rape, (18 PA.C.S.A  §3121)
  • Statutory Sexual Assault, (18 PA.C.S.A  §3122.1) 
  • Involuntary Deviate Sexual Intercourse, (18 PA.C.S.A  §3123)
  • Sexual Assault, (18 PA.C.S.A  §3124.1)
  • Institutinal Sexual Assault, (18 PA.C.S.A  §3124.2)
  • Aggravated Indecent Sexual Assault, (18 PA.C.S.A  §3125)
  • Incest, (18 PA.C.S.A  §4302)
  • Stalking when graded as a Felony 3, (18 PA.C.S.A  §2709(b),(c)(2)(ii))
  • Arson, (18 PA.C.S.A  §3301
  • Kidnapping, (18 PA.C.S.A  §2901)
  • Burglary, (18 PA.C.S.A  §3502)
  • Robbery, (18 PA.C.S.A  §3701)
  • Robbery of a Motor Vehicle, (18 PA.C.S.A  §3702)
  • Theft by Extortion, w/ threat of violence, (18 PA.C.S.A  §3923)
  • Aggravated Harassment by a Prisoner, (18 PA.C.S.A  §2703.1)
  • Assault by a Prisoner, (18 PA.C.S.A  §2703)
  • Assault by a Life Prisoner, (18 PA.C.S.A  §2704)
  • Murder of Unborn Child, Reg. of Deg., (18 PA.C.S.A  §2604)
  • Voluntary Manslaughter of Unborn Child, (18 PA.C.S.A  §2605)
  • Promoting Prostitution of a child under 16, (18 PA.C.S.A  §5902(b) as a Felony 3))
  • Obscene & Other sexual material as F3, (18 PA.C.S.A  §5903)
  • Indecent Assault, victim under 13, (18 PA.C.S.A  §3126(a)(7) as an M1))
  • Sexual Abuse of Children, (18 PA.C.S.A  §6312)
  • Criminal Attempt, Solicitation, or Conspiracry to commint any of the above offenses, (18 PA.C.S.A  §901,902 & 903)
  • A crime equivalent to any of the above listed offenses under the laws of the Commonwealth at the time of the commission of the offense.
